CONTRATO DE SERVICIOS QUE CELEBRAN “EL PRESTADOR DEL SERVICIO” Y “EL CONSUMIDOR “CUYOS NOMBRES Y DATOS CONSTAN EN EL ANVERSO DE ESTE DOCUMENTO COMO PARTE INTEGRAL DEL MISMO, SUJETÁNDOSE AL TENOR DE LAS SIGUIENTES CLÁUSULAS.
1a. El objeto de este contrato es el lavado y planchado de las prendas que en el anverso se describen, en caso de ser diferente se especificará.
2a. Deberán quedar especificados en la orden de servicio: a) el monto total a pagar por la operación del servicio y/o servicios adicionales; b) La fecha de entrega; c) Cualquier deterioro que tenga la prenda, incluyendo adornos y aplicaciones; d) Cualquier riesgo que corra la prenda por el proceso; e) El proceso a que será sometida la prenda cuando ésta no tenga etiqueta de instrucciones de limpieza; f) Las manchas o decoloraciones visibles, y g) Por lo que se refiere a prendas de alta costura o diseño que superen un valor de $8,000.00 pesos, características que guarda, servicio solicitado, precio del servicio, límite de garantía, fecha de entrega y riesgo que corren, serán convenidos previamente y por escrito entre “El consumidor” y “El prestador del servicio” en el anverso de este contrato. Todo tipo de cortinas y prendas que por su naturaleza sean expuestas al sol o a la intemperie no serán objeto de garantía, lo cual quedará por escrito en la orden de servicio.
3a. “El prestador del servicio” no está obligado a eliminar las manchas que por su naturaleza sean insolubles. Asimismo, no será responsable por las manchas no perceptibles a la vista al momento de la recepción de la (s) prenda (s) y que surgieran durante su proceso de lavado y/o planchado, tales como los residuos de perfumes, ácidos, desodorantes o exudación. En el caso del servicio exclusivamente de planchado “El prestador del servicio” no se obliga a restablecer la apariencia original de la (s) prenda (s) en lo que se refiere a tersura y/o tamaño.
4a. El prestador del servicio se obliga a: a) Informar al consumidor el monto total a pagar por la operación del servicio, incluyendo el precio de los servicios adicionales, así como las restricciones que, en su caso, sean aplicables en la prestación del servicio objeto de este contrato mismas que deberán ser anotadas en la orden de servicio; b)Revisar el estado que guardan las prendas, haciendo ver al consumidor cualquier deterioro o riesgo en el proceso de limpieza, fijando el límite de garantía; c) Seguir las instrucciones de lavado y/o planchado contenidas en las etiquetas en idioma español; d) Reparar las prendas en caso de deterioro parcial imputable a él mismo, dentro de los treinta días siguientes a la presentación de la inconformidad de “El consumidor”, sin costo alguno para éste, aun cuando se haya subcontratado el servicio con terceros; e) Devolver el importe del servicio no realizado cuando previamente se haya cobrado; f) Indemnizar en caso de deterioro total o pérdida, salvo causas de fuerza mayor, a su propietario hasta con un máximo de 12 veces el precio del servicio pactado por dicha prenda, o un máximo del 60% del valor de la prenda que las partes de común acuerdo hayan declarado o en su defecto, que “El consumidor” pueda demostrar fehacientemente, en caso de no haber manifestado el valor de la prenda como lo establece la cláusula sexta inciso (f), el proveedor sólo se obliga a pagar el 60% de $8,000.00 (ocho mil pesos) como valor máximo de la prenda ; g) Corregir sin cargo extra, las deficiencias en el servicio que “El consumidor” encuentre en el momento de recoger las prendas. La garantía se limita al cumplimiento del servicio solicitado, y se hará válida en el mismo establecimiento. Salidas las prendas del establecimiento no se admite reclamación por este concepto; h) Entregar las prendas en el día pactado en la orden de servicio, salvo causas de fuerza mayor; i) Identificarse plenamente ante el consumidor en el caso de que se preste el servicio a domicilio, de haber un cargo adicional por dicho servicio se especificara en el anverso del presente contrato; j) Preguntar a “el consumidor” si alguna de las prendas es de alta costura o diseño que superen un valor a $8,000.00 pesos.
5a. “El prestador del servicio” no es responsable de: a) Objetos y/o valores olvidados en las prendas; b) Los daños que pudiera sufrir la prenda en caso de que ésta no cuente con instrucciones de lavado o sean erróneas; c) por las alteraciones de colores producidas por el sol, colores o estampados no sólidos, manchas manipuladas previamente por el “consumidor” y por las manchas no perceptibles a simple vista, tales como residuos de desodorante, perfumes, exudación o ácidos, así como también baja de tono y/o textura que surgiera durante el proceso de lavado a causa de la calidad del teñido y/o confección textil por parte del fabricante, deterioro de rellenos, entretelas y partes ocultas de la prenda, y del estado de limpieza o planchado que guarden las prendas después de treinta días a partir del día pactado para su entrega; d) En el caso de la (s) prenda (s) de alta costura, diseño y las prendas que superen el valor de $8,000.00 (ocho mil pesos) de las cuales el consumidor haga mención, las garantías serán de acuerdo al tipo y características de la prenda y quedarán establecidas de común acuerdo entre las partes, lo cual quedará por escrito en el anverso de este contrato.
6a. “El consumidor”; deberá: a) Pagar en efectivo en el establecimiento al momento de ordenar el servicio o al recoger las prendas a elección del consumidor, en moneda nacional, o extranjera que acepte “El prestador del servicio”. Las prendas para efectos de control no serán entregadas en forma parcial; b) Recoger las prendas en la fecha convenida c) Verificar que son las mismas que entregó para su servicio d) Pagar por concepto de almacenaje, después de treinta días, el 1% sobre el valor del servicio por cada día que transcurra; en ningún caso el pago por el almacenaje excederá del monto total. En caso de que transcurran noventa días sin que “El consumidor” recoja su (s) prenda (s), “El prestador del servicio” se constituirá como acreedor prendario respecto de la (s) misma (s) pudiendo ejecutar la prenda de manera inmediata, en términos de las disposiciones legales aplicables ; e) En caso de no presentar la orden de servicio, exhibir una identificación oficial, firmar de recibido en la copia de la orden de servicio; f) “El consumidor” deberá manifestar el valor de la prenda cuando el costo sea mayor a $8,000.00, en caso de indemnización, deberá de comprobar el valor de la prenda de manera fehaciente con ticket de compra.
7a. Son causas de terminación del presente contrato: a) Que “El consumidor” antes de que se haya iniciado el proceso, avise a “El prestador del servicio” que no quiere utilizar el servicio; b) que “El prestador del servicio” detecte que la prenda o sus accesorios pudieran sufrir daño. En estos casos no habrá indemnización para ninguna de las partes.
8ª. Son causas de rescisión del presente contrato: a) que “El proveedor” no cumpla con la entrega de la (s) prenda (s) en la fecha establecida en la orden de servicio del presente contrato.
9ª. Pena convencional: se establece como pena convencional para el prestador del servicio en caso de incumplimiento en fecha de entrega, el pago del 1% del valor del servicio por cada día que transcurra sin rebasar el monto total del servicio solicitado, asimismo se establece como pena convencional para el consumidor el pago por concepto de almacenaje establecido en la cláusula 6ª. Inciso d de este contrato.
10a. La recepción de este documento y la entrega de la (s) prenda (s) implican la aceptación del presente contrato.
11a. Para dirimir cualquier controversia las partes se someten a la vía administrativa de la Procuraduría Federal del Consumidor

Where we store your personal data
The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic
Area (“EEA“) for our own administration purposes. It may also be processed by staff operating outside the EEA who
work for us or for one of our suppliers. Such staff may be engaged in, among other things, the fulfilment of your
order, the processing of your payment details and the provision of support services. Whenever we transfer your data
